不少大學生為了改善經濟狀況、了解市場行情、增(zeng)長(chang)社(she)會(hui)經(jing)驗(yan),在(zai)暑(shu)期(qi)選(xuan)擇(ze)兼(jian)職(zhi)打(da)工(gong),這(zhe)是(shi)值(zhi)得(de)提(ti)倡(chang)的(de)。但(dan)是(shi),大(da)學(xue)生(sheng)暑(shu)期(qi)兼(jian)職(zhi)的(de)法(fa)律(lv)困(kun)惑(huo)也(ye)不(bu)少(shao)。是(shi)否(fou)簽(qian)訂(ding)合(he)同(tong)?簽(qian)訂(ding)勞(lao)動(dong)合(he)同(tong)還(hai)是(shi)勞(lao)務(wu)合(he)同(tong)?若(ruo)用(yong)工(gong)單(dan)位(wei)拒(ju)簽(qian)合同怎麼辦?這些讓不少年輕人煩惱的問題,值得我們深思。
首先,在校大學生需要有強烈的合同意識。在農耕經濟時代,由於是熟人社會,靠村規民約、xisuguanlijiunengdazhitiaozhenghaobicideguanxi,dangshikaoshurenquanqiangdadeyulunyalijiunengcushishuangfangchengxinhezuo。xianzaishishichangjingjishidai,renmenjibenshangdoushitongmoshengrendajiaodao,bicideguanxidekaofazhilaiweixi,hetongjiushijibendefalvgongju。yinci,daxueshengyidingyaoyouzheyangdeguannian,qiandinghetongjishishuangfangquanliyiwudejibenyiju,yeshiyufangjiufendefabaohejiejuezhengyideliqi。
再者,隻要用工單位同意,大學生就應盡量與之簽訂勞動合同。這是因為勞動關係獲得的保障遠大於勞務等關係,前者有最低工資、工作時間、加班費、社(she)會(hui)保(bao)險(xian)等(deng)方(fang)麵(mian)的(de)強(qiang)製(zhi)性(xing)保(bao)障(zhang),後(hou)者(zhe)隻(zhi)是(shi)一(yi)般(ban)民(min)事(shi)關(guan)係(xi)。別(bie)的(de)不(bu)說(shuo),勞(lao)動(dong)關(guan)係(xi)中(zhong)的(de)勞(lao)動(dong)者(zhe),在(zai)上(shang)班(ban)期(qi)間(jian)若(ruo)受(shou)傷(shang),可(ke)享(xiang)受(shou)工(gong)傷(shang)待(dai)遇(yu),甚(shen)至(zhi)上(shang)下(xia)班(ban)途(tu)中(zhong)受(shou)傷(shang)也(ye)能(neng)享(xiang)受(shou),這(zhe)就(jiu)是(shi)一(yi)項(xiang)巨(ju)大(da)福(fu)利(li)保(bao)障(zhang),且(qie)主(zhu)要(yao)由(you)社(she)會(hui)保(bao)險(xian)而(er)不(bu)是(shi)用(yong)工(gong)單(dan)位(wei)來(lai)支(zhi)撐(cheng)。別(bie)小(xiao)看(kan)了(le)這(zhe)項(xiang),畢(bi)竟(jing)“天有不測風雲”,例如,上下班途中出意外遭受重傷,勞動者一生都有保障;哪怕出意外身故了,勞動者的近親屬也能獲得補償。這是勞務關係遠無法比擬的。
在網絡輿論場和現實生活中,有人拿原勞動部《關於貫徹執行〈中華人民共和國勞動法〉若幹問題的意見》第12條——“在校生利用業餘時間勤工儉學,不視為就業,未建立勞動關係,可以不簽訂勞動合同”的(de)規(gui)定(ding)來(lai)說(shuo)事(shi),稱(cheng)大(da)學(xue)生(sheng)打(da)工(gong)不(bu)能(neng)簽(qian)訂(ding)勞(lao)動(dong)合(he)同(tong)。該(gai)觀(guan)點(dian)一(yi)度(du)廣(guang)為(wei)流(liu)傳(chuan),造(zao)成(cheng)嚴(yan)重(zhong)誤(wu)導(dao)。值(zhi)得(de)注(zhu)意(yi)的(de)是(shi),這(zhe)個(ge)文(wen)件(jian)僅(jin)限(xian)定(ding)為(wei)學(xue)校(xiao)組(zu)織(zhi)或(huo)學(xue)校(xiao)開(kai)具(ju)勤(qin)工(gong)儉(jian)學(xue)介(jie)紹(shao)函(han)去(qu)打(da)工(gong)的(de)情(qing)形(xing),而(er)且(qie)它(ta)是(shi)1995年製定的,規定雖未廢止卻已明顯滯後。另外,勞動法並未禁止大學生成為勞動主體,根據勞動合同法的規定,大學生利用雙休、法定節假日,從事“非全日製用工”行xing為wei,可ke以yi建jian立li勞lao動dong關guan係xi,在zai校xiao大da學xue生sheng與yu用yong工gong單dan位wei形xing成cheng勞lao動dong關guan係xi並bing沒mei有you法fa律lv障zhang礙ai。因yin此ci,選xuan擇ze在zai寒han暑shu假jia打da工gong的de大da學xue生sheng,完wan全quan可ke以yi簽qian訂ding勞lao動dong合he同tong,在zai實shi踐jian中zhong已yi有you不bu少shao判pan例li支zhi持chi該gai觀guan點dian。
另(ling)外(wai),用(yong)工(gong)單(dan)位(wei)同(tong)大(da)學(xue)生(sheng)雖(sui)簽(qian)訂(ding)為(wei)勞(lao)務(wu)合(he)同(tong),若(ruo)符(fu)合(he)勞(lao)動(dong)關(guan)係(xi)特(te)征(zheng),依(yi)然(ran)可(ke)認(ren)定(ding)為(wei)勞(lao)動(dong)關(guan)係(xi)。例(li)如(ru),用(yong)工(gong)單(dan)位(wei)讓(rang)大(da)學(xue)生(sheng)填(tian)寫(xie)了(le)入(ru)職(zhi)登(deng)記(ji)表(biao),為(wei)其(qi)建(jian)立(li)了(le)員(yuan)工(gong)檔(dang)案(an)、發放工牌、angudingzhouqijigudingshuezhifulaodongbaochoudeng,youqishiyoushouyonggongdanweirichangguanlizhilishuguanxidezhengju,jiuyourendingweilaodongguanxideyudi。yinci,daxueshengyingzhuyibaocunzhefangmiandezhengju,wanyichuxianjiufen,jiunengyicizuoweiweiquanyiju。
若(ruo)用(yong)工(gong)單(dan)位(wei)就(jiu)是(shi)不(bu)願(yuan)簽(qian)訂(ding)勞(lao)動(dong)合(he)同(tong),兼(jian)職(zhi)大(da)學(xue)生(sheng)也(ye)可(ke)與(yu)其(qi)簽(qian)訂(ding)勞(lao)務(wu)合(he)同(tong),這(zhe)總(zong)比(bi)不(bu)簽(qian)訂(ding)任(ren)何(he)合(he)同(tong)要(yao)好(hao)。如(ru)果(guo)用(yong)工(gong)單(dan)位(wei)開(kai)出(chu)的(de)報(bao)酬(chou)待(dai)遇(yu)不(bu)錯(cuo),或(huo)者(zhe)報(bao)酬(chou)一(yi)般(ban)但(dan)其(qi)他(ta)方(fang)麵(mian)的(de)附(fu)加(jia)值(zhi)可(ke)觀(guan),即(ji)使(shi)用(yong)工(gong)單(dan)位(wei)就(jiu)是(shi)不(bu)願(yuan)意(yi)簽(qian)訂(ding)書(shu)麵(mian)合(he)同(tong),大(da)學(xue)生(sheng)也(ye)可(ke)謹(jin)慎(shen)接(jie)受(shou)。因(yin)為(wei)口(kou)頭(tou)合(he)同(tong)也(ye)是(shi)合(he)同(tong),前(qian)麵(mian)提(ti)到(dao)的(de)“非全日製用工”,法律規定就是“可以訂立口頭協議”。口頭合同的內容,隻要有證據證明而不是“口說無憑”,也是能受到法律保護的。
因此,在未簽訂書麵合同的情形下,大學生在應聘過程中一定要注意收集和保全證據,包括溝通中的微信、短信、QQ聊天和電子郵件等。在當麵洽談打工條件時,可進行全程錄音,內容一般應包括合同期限、每天工作時間、工作地點、工作崗位、工作任務、工作報酬、是否受單位管理、有無雙休、有無加班工資、有(you)何(he)福(fu)利(li)待(dai)遇(yu)等(deng),都(dou)應(ying)當(dang)明(ming)確(que)談(tan)及(ji)談(tan)妥(tuo)。如(ru)此(ci)這(zhe)般(ban),口(kou)頭(tou)合(he)同(tong)和(he)實(shi)際(ji)工(gong)作(zuo)情(qing)況(kuang)符(fu)合(he)法(fa)定(ding)條(tiao)件(jian)的(de),也(ye)可(ke)認(ren)定(ding)為(wei)事(shi)實(shi)勞(lao)動(dong)關(guan)係(xi)。基(ji)於(yu)上(shang)述(shu)思(si)考(kao),我(wo)們(men)應(ying)當(dang)更(geng)清(qing)楚(chu)地(di)看(kan)到(dao),大(da)學(xue)生(sheng)暑(shu)期(qi)打(da)工(gong)的(de)權(quan)益(yi)是(shi)有(you)法(fa)律(lv)保(bao)障(zhang)的(de),年(nian)輕(qing)人(ren)也(ye)應(ying)當(dang)盡(jin)力(li)維(wei)護(hu)自(zi)己(ji)的(de)合(he)法(fa)權(quan)益(yi)。
